The Digital Health Update by Paul Sonnier ⋅ Aug 25, 2016 ⋅ #236

Dear Group,

Werner Herzog’s new documentary ‘Lo and Behold: Reveries of the Connected World‘ is a tour de force for several key areas of digital health. Covering the dawn of the Internet in 1969 through to today and into the future, Herzog examines issues of privacy, cyberbullying, wireless radiation sensitivity, cyber security, Internet addiction, artificial intelligence, assistive robots, autonomous vehicles, and space exploration. As we know—and the reason I included the digital revolution’s impact on living and society in my definition of digital health—society depends on the Internet for nearly everything. But as Herzog shows us in his playful and chilling film, we rarely step back and recognize its endless intricacies and unsettling omnipotence. I thoroughly enjoyed Herzog’s documentary style and poignant vignettes showing how the Internet (yes, I capitalize it!) is unlike any other technology in its impact on our lives.

With some health insurance companies offering premium discounts for plan members using fitness trackers, the motivation to cheat can be problematic, and not just for undermining one’s own healthy, disease-preventing physical activity. In a light-hearted video segment, WIRED suggests five ways to cheat your Fitbit but also states that it’s ‘fraud’ if you do this for the purpose of cheating on your health insurance. This seemed like a rather harsh description for someone doing this. Fraud is defined as “wrongful or criminal deception intended to result in financial or personal gain.” And “Breach of contract” is “a legal cause of action in which a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other party’s performance.” I’m no lawyer, but it seems that the latter is more likely the case rather than fraud. For the many attorneys in the group, please feel free to share your thoughts in the group discussion for this announcement.
